Why State Guard Units/State Defense Force Units (the Naval Militia being the equivalent in NJ) are not only needed in every State, but are a crucial component of Homeland Security

California State Military ReserveThe California State Military Reserve (CSMR) is the equivalent to the New Jersey Naval Militia and the other 26 existing state guard units across the United States (see State Guard Association below), which is an all-volunteer (18 - 63) State Defense Force--authorized by United States Code (32 USC 109c)--whose primary mission is to support the California National Guard (CNG) in its Homeland Security missions such as Disaster Mitigation Recovery, Small Arms Weapons Training, Military Police, etc. The New Jersey Naval Militia and the New Jersey State Guard are organized as a single joint regiment designated as the New Jersey Naval Militia Joint Command (NJNMJC). NJNMJC is organized and controlled pursuant to N.J.S.A. 38A:1-3(a) and N.J.S.A. 38A:3-6. NJNMJC was originally authorized by the Governor of New Jersey in 1894. It is a state militia force only. After being deactivated and absorbed by the US Naval Reserve in 1963, it was reactivated by former Governor Whitman in 1999.

The mission of the NJNMJC is to provide naval support and a military waterborne force. It receives no funding and is not allowed to recruit new members. The only recognition or support the NJNMJC receives from the State of New Jersey is space for headquarters at Ft. Dix and drill assembly training space in the Plainfield Armory. The organization has kept current on topics such as weapons of mass destruction, hazardous materials, counterterrorism and the national response plan. Additionally, it has received certifications as a Community Emergency Response Team (CERT) and basic Military Emergency Management Specialist (MEMS). The NJNMJC is actively pursuing the Senior and Master MEMS certification (see Governor Chris Christie’s DMAVA Transition Report on the Department of Military and Veterans’ Affairs for more details located at http://www.state.nj.us/governor/ ).

An excerpt from the Committee Report on the New Jersey Naval Militia Joint Command (NJNMJC) to the Adjutant General on the accomplishments of the Naval Militia--

Following activation, the NJNMJC participated in several major events (e.g. Hurricane Floyd, OPSAIL 2000) and was employed extensively in a variety of roles after 9/11....

On September 11, 2001 members of the 2nd Division, New Jersey Naval Militia, assigned to Patron 10, placed one vessel, PBU 23-1, (Patrol Boat Utility), a 23' aluminum convention displacement hull with enclosed cabin, equipped with radar, global positioning device, depth indicator, marine hailer, VHS radio, and powered by twin 1989 outboard motors, at the disposal of the United States Coast Guard and State Guard Units. The vessel was deployed for the purpose of security at and around the World Trade Center (WTC) Site. During the weeks following the disaster, a second vessel, PBU 23-2 was made available to assist. A third vessel, PBU 23-4, was placed in service in November 2001. The following is a list of missions that were accomplished from September 11, 2001 to July 30, 2002:

1. Waterborne security at the bases of the George Washington Bridge
2. Daylight vessel traffic control on the Hudson River, north of the George Washington Bridge
3. Standby vessel for search and rescue detail Coast Guard Station Sandy Hook, NJ
4. Transport of military personnel and equipment from NJ to North Cove (Ground Zero)
5. V.I.P. transportation and security detail for Liberty State Park tribute events during October 2001
6. 192 days of water-borne security assisting naval personnel at Naval Weapons Station Earle
7. 180 days of continuous daylight patrols assisting the NJ State Police at Salem Nuclear Generating Station, Salem, NJ
8. Assisted with security in Jamaica Bay, NY during the aftermath of the crash of Flight 194, Kennedy Airport

In addition, the following land-based missions were assigned and accomplished:
1. Personnel to man the military Joint Operations Center
2. Chaplain services at Ground Zero and the Staten Island Logistics Support Base
3. Development and presentation of an anthrax awareness program to all N.J. Army National Guard troops in the field
4. Physical security augmentation at Fort Dix and NAES Lakehurst
5. Logistical support at Ground Zero for the Disaster Medical Assistance Team (DMAT)
6. Warehouse management for the Salvation Army....

The Naval Militia offered a great service for New Jersey.

When the NJ Naval Militia was reactivated by Governor Christie Todd Whitmann in 1999, it had bi-partisan support by both Democrats and Republicans--please call your Governor, State Senators and Assemblymen and ask them to take the NJ Naval Militia off "stand down" mode and start recruiting new members. This would save our State and local governments a lot of money and be very beneficial to the Homeland Security operations in the State of New Jersey. Unfortunately, the existing Adjutant General Glenn K. Reith—who was appointed in 2002-- has been indifferent and non-supportive to the Naval Militia, which is regrettable considering many retired and active high ranking military officers and former adjutant General’s fully support the Naval Militia and appreciate the benefits it brings to the Homeland Security function in the State of New Jersey, especially on 9/11. The different agencies should put aside their petty jealousies and work for the benefit of the people instead trying to protect their fiefdoms. Governor Chris Christie (who is an honorable man and believes in truth, justice and honesty) should put a stop to this non-sense and allow recruitment of new members for the Naval Militia. Consolidation of Township Police Departments into the Sheriff's Office

All New Jersey township police departments should be merged into the county Sheriff's Department with satellite offices in each township if needed. [Your county police departments (do not start a separate county police force or merge existing township police departments; this would end up being very costly like Bergen County Police--that should be merged into the Bergen County Sheriff's Office--or Nassau County) are already established through your Sheriffs' Departments and would be advantageous to merge the existing township police departments in each county into their existing county Sheriff's Department (this can be done by each township on a contractual basis with the county)]. I have spoken to many retired New Jersey State Troopers and former or current Sheriffs who agree that the local police departments should be merged into county Sheriff's Office, an existing county police force. It should also be noted that former county Judge Thomas J. Beetel of Flemington, NJ (who served in World War II in Naval Intelligence--China) proposed having the Sheriff’s Office patrol the county and former Mayor Andrew Leon of Delaware Township, NJ (who served in World War II as a Navy Seabee—Guam and Bikini Atoll) was against starting a township police department.

The NJ Clinton (actual location is in Perryville) State Police Barracks has one Lieutenant to oversee over 30 New Jersey State Troopers; Kingwood Township the NJ State Police patrol the area because Kingwood Township has no township police department and is considerably less costly that having their own police department. (Under an agreement with the State years ago, the township does not have to pay for their service, but it would still be considerably lower in cost if they had to pay for the NJ State Police service compared to having their own police departmen. So, if a township uses the NJ State Police, keep using their services--if you need to supplement them, contract out with the Sheriff's Office).

Contracting out the services of the Sheriff's Office will not only lower the overall cost, but would be very beneficial for Homeland Security, especially if the all the specialities are under its umbrella such as Emergency Services (Swat), Investigations, Terrorism Task Force, etc. The current cost of having individual township police departments in New Jersey is astronomical and is totally unnecessary (with the exception of park rangers); for example, a local police Dept. in Hunterdon County is 23% of the boro’s budget as of 2008—they patrol 1.3 square miles/3.37 square kilometers. (Note: This percentage does not necessarily account for the true cost of operating a township police department—when the full costs are accounted properly such as pensions, the percentage cost can be anywhere from 30% to 50% of the townships’ budget.) Also, the pension ratio was raised from 60% to 65% after 25 years. Each individual township police dept. has a chief, Captains, Lieutenants, Sergeants, etc. Because of the economic situation, it is more feasible to merge a twp. police department into the Sheriff's Office on a contractual basis. In other words, the township would pay the county (based on the number of officers they need and unit hours) for the existing twp. police officers to patrol their township--so basically you would have the same officers patrolling the township, but at a lower cost to the taxpayers. If times were not as bad, the township police departments could be gradually phased out over a period of 15 to 20 years—this would allow for no layoffs of current police officers’ and a smooth transition to the Sheriff’s Office and the Officers would have more opportunity under the Sheriff's Office.  (Merging into the Sheriff's Office will usually prevent layoffs; however, twp. police departments mergering with other twp. police departments usually involve layoffs and do not save any money in the long run and leads to the county taken over the consolidated twp. police departments.)

There should be no age limit, which is the current policy for Sheriffs' Departments--there are a lot of retired military personnel and other highly qualified individuals that are in excellent physical shape and are valuable assets to the many Sheriffs' Departments across this nation. (The current police academies in New Jersey should offer a night and weekend program for individuals who work full-time and need to be certified—not full-time only.) [There is little accountability with your local police departments—if the Sheriff’s Department is mistreating the citizens of a county such as unauthorized traffic stops, the Sheriff can be voted out and is more likely to take a citizen’s complaint seriously; this is not the case with local police departments that are out of control and have far too many officers. It should be noted that the Hunterdon County Freeholder’s decision made in the late 1970’s to take away control of the county jail from the Sheriff’s Department was stupid and cost the taxpayers more money by putting it under the control of the Division of Corrections, which is now under the Department of Public Safety created in 2005—see DPS. Hunterdon County did not have a Division of Corrections until it was created by the Freeholders in 1978 (in all fairness to the Freeholders the current Sheriff at that time was incompetent, but the Warden ran the jail anyway). It should also be mentioned that Atlantic County Sheriff's Department is in charge of the patrol operations—yes, the sheriff officers patrol the county. Communications and the county jail should be under the control of the Sheriff’s Department. Also, Pennsylvania’s District Attorneys (New Jersey’s equivalent to the Prosecutor) are elected—see PDA website.] Also, see Police/Sportsmen Tab to read the 2008 Sheriff’s Office advisory report that would not be released by the Freeholders for the police merger report done by Blue Shield of Morristown.

Unfortunately, you have a lot of misinformed township committee members and county freeholders who are either afraid of the police and PBA or do not want to do what is right for the taxpayers (the Federal government and State governments are going broke or are already broke) or they have a vested interest in keeping these high cost township police departments.  One township committee member made a comment that their salaries and huge pay increases are justified because they carry a gun—the Raritan Township Committee person is very misguided to make such a stupid statement (should security guards, military police, concealed carry license holders, etc. get a million dollars because they carry a gun?—this does not warrant out of control salaries).  Police/Detectives are listed as number six (6) on the list when is comes to fatalities and did not even make the top ten (10) for injuries incurred on the job according to the U.S. Dept. of Labor. FBI wants businesses watching for customers paying with cash--Government calls buying 'night flashlights,' making 'extreme religious statements' indicators of terrorism

"This new handout expands the absurdity by now also targeting customers of military surplus stores, and by specifically targeting the purchasing of very common, and very popular, preparedness items such as Meals Ready to Eat (MREs) as 'potential indicators of terrorist activities,'" said a statement from Oath Keepers founder Stewart Rhodes.

That motto is a sad remnant of the Founders' ideal of a prepared citizenry," Rhodes wrote.

Editor Joseph Farah of worldnetdaily responded to the SPLC ‘s accusation that he could not be reached for comment over his positions:

"Could not be reached for comment?" asked Farah in a response column. "Let me state unequivocally and for the record, the gutless, little cowards at the Southern Poverty Law Center with their $300 million annual budget never had the courage to call me, leave a message or send an e-mail! I would have been amused to answer the accusations of [SPLC Founder Morris Dees] or one of his little minions. Anyone who knows me understands how much I like to mix it up with those who disagree with me. Could not be reached for comment, indeed. Larceny and cowardice are the trademarks of Dees and company.

What about the Partriot Act Extension?

S. 990 extended for four years three provisions of the Patriot Act that were set to expire. The three provisions are: 1. The "roving wire tap" provision that allows the federal government to wiretap any number of a suspect's telephone/Internet connections without specifying what they will find or how many connections will be tapped; 2. the "financial records" provision that allows the feds to seize "any tangible thing" that has "relevance" to an investigation; 3. the "lone wolf" provision that allows spying on non-U.S. citizens without a warrant. These provisions violate the Fourth Amendment of the U.S. Constitution, which requires that no warrants be issued "but upon probable cause" (a much highter standard than "relevance"), and that warrants must contain language "particularly describing the place to be searched, and the persons or things to be siezed."

Under the Patriot Act, the FBI can issue warrants called "National Security Letters" without going to a judge. This provision never expired.

All law enforcement personnel should have opposed the extension of the Patriot Act--your oath is to the U.S. Constitution, not to your superior or pay check. The so-called "War on Terror" is lost if the U.S. Constitution is destroyed or gutted. Why is the border not being sealed? Many retired Federal Agents have spoken out about this and many other issues at anti-terrorism symposiums.

What about The National Defense Authorization Act (NDAA)?

This is one of the most disgraceful pieces of legislation ever passed--it was approved by the House of Representatives (283 - 136) and the Senate (86 - 13) on Dec. 15, 2011. Since this bill labels all of America a "battlefield" in the "War on Terror", it can hold American citizens without charges or a trial for an indefinite detention. It will also allow the Pentagon to treat the Internet as a 'battlefield". So any dissent on the internet could be quashed. This bill gives the president enormous powers under section 1021 to arrest and jail people, by use of the military, without due process (see the 5th & 6th Amendment).

The use of admiralty courts (military tribunals) and the applying the laws of war to the colonists and the infamous Star Chamber in English history was the reason the Founding Fathers made sure that international laws of war would apply only to foreign enemies--they can now be applied to American citizens. The Article II Treason Clause establishes for non-military citizens to be tried in a civilian court. Also, international laws do not trump our Bill of Rights. One of the causes for the American Revolution was the denial of the right to a jury trial. Every member of Congress that signed this bill should be thrown out of office. It has nothing to do with "Homeland Security."

TheHill.com posted this report quoting Dr. Ron Paul [a Republican Congressman in the 14th district in Texas, who served in the United States Air Force as a flight surgeon (1963 to 1965) and the U.S. Air National Guard (1965 to 1968)] and stated the following: "GOP presidential candidate Ron Paul warned that the National Defense Authorization Act, which was passed by Congress this month, will accelerate the country's 'slip into tyranny' and virtually assures 'our descent into totalitarianism.'

President Barack Obama has signed this bill (NDAA) from his vacation rental in Kailua, Hawaii making this his last official act in 2011. Two retired four-star Marine generals wanted the president to veto the bill in a New York Times op-ed stating it is "misguided and unnecessary." Osama bin Laden was just handed a victory with the passage of this bill.

Historical note: In 1933, the German Reichstag passed the Enabling Act, granting to Adolf Hitler the expansive powers that helped create his ruthless dictatorship. The NDAA gives similiar powers to the President and for much the same reason: the protection of the people.

The priviledge of a writ of habeas corpus (dervived from the Latin for "you may have the body") guaranteed by Article I, Section 9 of the Constitutition has now been suspended. Now a U.S. citiizen does not have the right to due process of law and the right to know what charges are being made against him. The concept of habeas corpus formed a large part of the Anglo-American jurisprudence since the 14th century and the principles can be found in the Magna Carta written in 1215.

A quote from Alexander Hamilton (writing as a Publius) from The Federalist, No. 84:

The establishment of the writ of habeas corpus, the prohibition of ex post facto laws, and of TITLES OF NOBILITY, to which we have no corresponding provision in our Constitution, are perhaps greater securities to liberty and republicanism than any it contains. The creation of crimes after the commission of the fact, or, in other words, the subjecting of men to punishment for things which, when they were done, were breaches of no law, and the practice of arbitrary imprisonments, have been, in all ages, the favorite and most formidable instruments of tyranny.

Unfortunately, tyranny is being implemented little by little by the oligarchy currently ruling on Capitol Hill.

FBI Report Refutes the Anti-Second Amendment Politicians and Ignorant Law Enforcement Personnel

A recently released FBI 176-page report titled "Violent Encounters: A Study of Felonious Assaults on America's Law Enforcement Officers."

Summary of report:

  • Criminals do not get their guns through gun shows.
  • Criminals do not find "loopholes" in the law through which they get their guns.
  • Anti-gun laws do not stop criminals from getting guns; in fact, they don't even appear to slow criminals down.
  • The 33 handguns used to assault the officers who participated in the current study, 32 (97 percent) were obtained illegally. Eighteen of these were purchased or traded from other [criminals]; six were obtained during burglaries; four were taken from the victim officers during the incidents of examination; two were stolen during larcenies; one was stolen during a homicide; and one was illegally purchased from a firearm dealer in a store (straw purchase by a female associate). None of the rifles, shotguns or handguns connected with this study were obtained from gun shows or related activities.
  • The federal government has passed many laws to restrict and limit firearm purchases. The offenders in this research, however, stated that none of these laws or statutes deterred them.

Note: I want to compliment New Mexico Governor Bill Richardson (Democrat) with signing a bill (04/06/05) that improves the State's "shall-issue" concealed weapons carry system and encourages reciprocal agreements with other States--NJ should immediately change its law to "shall-issue"Rep. Harold Ford, Jr. (D-TN) should also be complimented for his strong support of law abiding citizens the right to bear arms. One of the biggest supporters for the right of citizens to defend themselves isLouisiana Governor Bobby Jindal (Republican) and the nation’s first Indian (Punjabi) American governor and Congressman Ron Paul (R-TX). Any politician not supporting a citizen’s right to defend themselves (2nd Amendment) is not interested in Homeland Security, but wants a police state (see article entitled Former Intelligence Chief (MI5) in Britain warns about police state).  A quote from a speech Attorney General John Ashcroftgave on 09/21/07 at the Celebration of American Values at the Capital Hilton in Washington, D.C.: “Any law passed by Congress which does not increase liberty is a bad law.”

Special Note: I am a firm believer in safety and training. All States should have uniform standards/ requirements for "concealed carry permit holders", which should consist of the following training courses:

  • Basic Pistol--14 hours;
  • Personal Protection Safety outside the home--14 hours;
  • Personal Protection in Home--8 hours; and
  • Home Firearm Safety--4 hours

A special designation could be offered on the "concealed carry" permit for "security personnel", which would require special training courses.

The "concealed carry license" should be a high quality license such as Florida's--the same quality as a photo drivers license. (All "concealed carry" applicants should go through the Sheriff's Office for processing in New Jersey--this is how it is done in most states and the New Jersey Sheriff's' Offices have electronic finger printing.) Because of the political situation in New Jersey, I think the above would be satisfactory to all members in the State Senate and Assembly including the Governor.  The "concealed carry license" could also authorize the NJ citizen to purchase the so-called "assault rifles", which are not fully automatic (just a semi-automatic rifle) and account for less than one-half of 1 percent of violent crime. This would be a big help for the police, military personnel and sportsmen/sportswomen who compete in shooting competitions and contribute to homeland security. The current States (37) with "shall-issue" carry permits have an impeccable record.

How should United States Citizens prepare themselves?

Every citizen should have a semi-automatic rifle (gas-piston model--.223), shotgun and pistol (see Police/Sportsmen Tab and Right-to-Carry Tab for detailed information on guns). It is impossible to protect your family or nation from heavily armed gangs, terrorists or an invading army with only a shotgun or pistol--you need a semi-automatic rifle (.223 or higher caliber). You should also have a gun safe (NJ exempts gun safes from sales tax). Of course, you should also have a generator (gas, propane or diesel generators are recommended) and other essential items such as the Gunnar Kiermaier's U.S Marine Survival Kits (see the heading below entitled Survival Sites for the United States Citizen for detailed listing of survival equipment and generators).

If husbands are not armed to protect yourself and family from terrorist attacks, gangs, looting, national disaster incidents, or a national invasion, then you have not taken Homeland Security seriously and have abdicated your responsibility in protecting your family and country. Note: Switzerland, which has a higher rate of firearms possession than the United States, was the only European country that the Germans were afraid to invade in both world wars. They knew every man was armed. The Swiss male citizens are supplied free of charge by the government a fully automatic rifle! (The Swiss have conscription or civil protection--mandatory military service were they can start being prepared at age 16.) In addition, every Swiss male citizen is required to keep his rifle and ammunition at home, to participate in group training, and to enter shooting matches. The Swiss have maintained their freedom for seven hundred (700) years and they had a profound influence on America's Founding Fathers regarding the Second Amendment. This was the land of William Tell, Ulrich Zwingli, William Farel and John Calvin, who had a deep mistrust of central governments. The State has delegated and limited authority by God in Scripture (Romans 13:1-7). Under the authority of the Bible, tyrannical power is to be resisted. The United States at one time prepared its citizens like Switzerland. When the United States Congress passed the "Militia Act of 1792", it defined "militia" of the United States as every adult male, not as the Continental Army. The act required each adult to possess a firearm and a minimum supply of ammunition and military equipment--this was the law and enforced into the twentieth century. Section 10 United States Code (USC) 311 reads: "The militia of the United States consists of all able-bodied males at least 17... [and] under 45 years of age who are or have made a declaration to become a citizen of the United States."  Additionally, another provision allows for a "reserve militia" (as opposed to the "ready militia" described above), that includes women, children and the elderly. This act was incorporated and used by many States in their constitutions--the State National Guard units were always separate from the militia provision. This same program should be implemented on a county level under the authority of the Sheriff.

Homeland Security has started a program with the Boy Scots. “The Explorers program, a coeducational affiliate of the Boy Scouts of America that began 60 years ago, is training thousands of young people in skills used to confront terrorism, illegal immigration and escalating border violence — an intense ratcheting up of one of the group’s longtime missions to prepare youths for more traditional jobs as police officers and firefighters,” reports the New York Times (see article entitled Scouts Train to Fight Terrorists and More;05/13/09). They use airsoft guns (non-lethal plastic BBs) for their tactical training, which have to have an orange tip on the muzzle by law. I am all for the program; however, the Homeland Secuirty program should be done on a county level through cooperation with the Sheriff's Office to make sure that the youth are being trained in the Constitution and Godly principles, not making them Gastapo Scouts for the federal government so they can be used against law abiding U.S. citizens. The current program with the Scouts mentioned here is being run by a Sheriff's Deputy in Imperial County, CA. This is the way it should be done.
